FIRB Rules for 461 Visa Holders

Because the 461 is a temporary visa, you are classified as a foreign purchaser under Australian property rules. That means you need Foreign Investment Review Board (FIRB) approval before you can buy property.

Your NZ citizen partner does not need FIRB approval — NZ citizens are exempt. But if you are on the title as a 461 holder, FIRB applies to you.

There is an important rule to know about: the Australian Government introduced an established-dwelling purchase ban for temporary visa holders running from April 2025 through March 2027. During this period, 461 visa holders cannot purchase established (existing) dwellings.

• Up to 90%+ LVR as a 461 visa holder buying on your own or as the primary applicant
• Up to 95% LVR when buying jointly with your NZ citizen partner — because your partner is treated like an Australian citizen for lending, lenders will consider the application under more favourable criteria

The key criteria lenders look for when approving above 80% LVR:

• Minimum 12 months remaining on your visa (exceptions may apply — ask us)
• Stable employment history — generally no more than 3 employers in the past 2 years
• Clean credit history — no defaults and minimal recent credit enquiries
• 5% genuine savings — held in your account for at least 3 months
