Yes. If you hold a New Zealand Citizen Family Relationship (subclass 461) visa, you can buy a house in Australia. This is one of the most common questions we hear from partners of NZ citizens, and the answer is straightforward — you are eligible to purchase property and access competitive home loan rates.

The 461 visa is a temporary visa issued to non-NZ-citizen partners (and dependent family members) of New Zealand citizens living in Australia. It is valid for 5 years and can be renewed. While your NZ citizen partner automatically holds a Special Category Visa (subclass 444) and can stay in Australia indefinitely, your 461 visa still gives you strong borrowing power — especially when lenders see both incomes on the application.

That said, buying on a 461 visa is not identical to buying as a citizen. There are a few extra steps, and the rules around foreign investment have tightened recently. Below we walk through every question 461 visa holders typically ask us.

Do You Need FIRB Approval on a 461 Visa?

Yes. Because the 461 is classified as a temporary visa, the Foreign Investment Review Board (FIRB) rules apply to you. Your NZ citizen partner does not need FIRB approval — NZ citizens are treated the same as Australians for property purchases — but you do.

Here is what that means in practice:

From April 2025 through March 2027, the Australian Government has banned temporary visa holders from purchasing established (existing) dwellings. This is a temporary measure and applies to all temporary visa holders, not just 461s.

The good news: you can still purchase new dwellings — house-and-land packages, off-the-plan apartments, and newly built homes that have not been previously occupied. Many of our 461 visa clients are using this period to buy brand-new properties, which often come with builder warranties, modern energy ratings, and stamp duty concessions in some states.

The FIRB application itself is a standard process. You lodge an application through the FIRB portal, pay the application fee (which varies based on your property’s purchase price), and wait for approval — usually within 30 days. Your mortgage broker can coordinate the FIRB timeline alongside your loan application so nothing holds up settlement.

How Much Deposit Do You Need on a 461 Visa?

The standard requirement for a 461 visa home loan is a 20% deposit, giving you an 80% loan-to-value ratio (LVR). This is the baseline most lenders work with for temporary visa holders purchasing on their own.

However, if you are buying with your NZ citizen partner — which is the most common scenario for 461 visa holders — you can access significantly better terms:

• 90% LVR — available through several lenders when a NZ citizen is on the application, meaning a 10% deposit
• 95% LVR — available in many cases when a NZ citizen partner is the primary applicant, meaning you may only need a 5% deposit plus costs

To put that in real numbers: on a $700,000 property, the difference between a 20% deposit and a 5% deposit is $105,000. That is the difference between needing $140,000 upfront versus $35,000 plus costs. For most couples, this makes the difference between buying now and waiting years to save.

Lenders’ mortgage insurance (LMI) will apply when borrowing above 80% LVR, which adds to your upfront costs. But in many cases, the LMI premium is far less than the cost of renting for additional years while you save a larger deposit. Your broker can run the numbers both ways so you can make an informed decision.

Can You Get the Same Interest Rate as an Australian Citizen?

Yes. As a 461 visa holder, you are not charged higher interest rates or fees compared to Australian citizens and permanent residents. There is no visa surcharge on your home loan rate.

You have access to the full range of loan products — variable rates, fixed rates, split loans, offset accounts, and redraw facilities. The rate you receive depends on the same factors that apply to any borrower: your deposit size, income, credit history, and the lender you choose.

This is different from some other temporary visas where lenders may apply restrictions or pricing adjustments. The 461 visa, particularly when paired with a NZ citizen co-borrower, is treated favourably by Australian lenders because of the strong connection to Australia that the NZ family relationship represents.

What If Your Bank Already Said No?

A bank declining your home loan application does not mean you cannot get approved. It means that particular bank, with their specific credit policies, said no on that day. Other lenders may have completely different criteria — and completely different answers.

This is the situation we see most often with 461 visa holders. The borrower goes to their regular bank, gets told they are ineligible or that they need a 30% deposit, and assumes that is the end of the road. It is not.

The reality is that each lender has its own credit policy for temporary visa holders, and those policies vary dramatically. Some major banks have restrictive policies for 461 visas. Can You Buy a House With Your NZ Citizen Partner?

Yes — and this is one of the biggest advantages for 461 visa holders. Buying jointly with your NZ citizen partner opens up lending options that are simply not available to you alone.

NZ citizens living in Australia are treated the same as Australian citizens for lending purposes. When your NZ citizen partner is on the loan application, lenders see a much stronger profile:

• Higher LVR available — up to 95% instead of 80%
• More lender options — some lenders that will not lend to a sole 461 visa applicant will happily approve a joint application with a NZ citizen
• Combined income — both incomes count toward your borrowing capacity, meaning you can qualify for a larger loan
• Stronger application — the NZ citizen partner’s residency status reassures lenders about long-term stability in Australia

FIRB approval is still required when a temporary visa holder is on the title, even in a joint purchase. But the lending terms are significantly better than applying solo. If your NZ citizen partner is the primary applicant and main income earner, you may qualify for the same terms as any Australian borrower — including high-LVR loans with lenders’ mortgage insurance.

What Happens When Your 461 Visa Expires?

The 461 visa is valid for 5 years and can be renewed as long as you remain in a genuine relationship with your NZ citizen partner and they continue to hold their Special Category Visa (subclass 444). The 461 visa subclass is confirmed as current in 2026, and there are no announced changes to its availability.

For your home loan, visa expiry is not typically a problem:

• Renewal — most 461 visa holders simply renew their visa and continue with their existing mortgage unchanged
• Pathway to permanent residency — depending on your circumstances, you may be eligible to apply for permanent residency through partner visa pathways (subclass 801/820), which removes FIRB restrictions for future property purchases
• Existing property — if you already own the property and your visa status changes, your existing mortgage continues as normal. Lenders do not recall loans because of visa changes

The key thing lenders want to see at application time is that you have sufficient visa duration remaining — typically at least 12 months. If your 461 visa is due for renewal soon, it can be worth renewing before you apply for your home loan to present the strongest possible application.
